In Texas, the dog bite laws are somewhat unique compared to most other states. The state operates under the “one-bite rule,” which states that the person injured can only recover compensation if the dog has bitten another person in the past. The rule protects owners in cases where their dogs have never shown signs of aggression or violence before. However, if a dog has bitten someone in the past or demonstrated aggressive behavior, the owner can be held responsible for any damages resulting from a dog bite. The victim can also potentially recover compensation based on three factors:

• Negligence – Negligent handling refers to situations where the dog owner or handler failed to control the animal adequately, resulting in harm to others.
  
  
• Strict Liabilities – This applies when a dog, despite having no prior history of aggression, displays dangerous behavior and the owner failed to take adequate precautions to prevent an attack.
  
  
• Intentional Misconduct – It occurs when a dog has been trained to act aggressively towards strangers and the owner deliberately allows or encourages their dog to attack someone.
