Under Texas state laws, limousines are classified as common carriers along with taxi companies and airlines, among others. This means that limousine service providers are subject to a higher standard of diligence and responsibility for the safety of passengers. Consequently, in the event of an accident, the presumption of fault immediately falls on the limousine driver. Furthermore, should the investigation reveal contributing factors such as faulty brakes, malfunctioning doors, or inadequate maintenance, the limousine company is considered negligent. For a claimant to successfully pursue a claim against a limousine company, the following must be proven: 

• Accident – The claimant must establish that a vehicular mishap involving the limousine occurred.  
• Injury – The claimant must demonstrate that they have suffered injuries or suffered damage as a result of the limousine accident.  
• Link Between Negligence and Injury – Because of the higher standard of care imposed on limousine providers as common carriers, the burden to prove they are not negligent during a limousine accident falls on them. Without sufficient evidence of lack of negligence, they are presumed negligent and, accordingly, liable for any injuries the claimant has sustained.
