Texas Dog Bite Law
Texas is often called a "one bite" state, but that label can be misleading. It doesn't mean a dog gets a free pass on its first bite. Under this common-law rule, an owner can be held strictly liable if they knew, or reasonably should have known, that their dog had dangerous tendencies. Just as important, you don't need to prove a prior bite to recover compensation: Texas law also allows negligence claims when an owner failed to reasonably control or restrain their dog, violated a local leash or animal control ordinance, or otherwise created an unsafe situation.
In the most serious cases, an owner whose unsecured dog causes serious injury or death in an unprovoked attack can face felony charges under Texas Health and Safety Code § 822.005, commonly known as Lillian's Law.
